Welcome to Bloom & Petal Co.! These Terms and Conditions outline the rules and regulations for the use of our services and online platform. By accessing this website and/or engaging with our services, you accept these terms and conditions in full. 1. Services Provided
Bloom & Petal Co. specializes in bespoke floristry and design services, including but not limited to:
- Custom floral arrangements
- Wedding and event floristry
- Daily flower delivery
- Corporate floral services
- Sympathy flowers
- Plant sales
- Terrarium workshops
- Floral subscriptions
- Dried flower installations
- Vase rentals
- Bouquet preserving
2. Orders and Cancellations
All orders are subject to availability. While we endeavour to match specified blooms and designs, floral products are subject to seasonal and market availability. We reserve the right to make substitutions with flowers of equal or greater value and similar aesthetic without prior notice to ensure the timely delivery of your order.
Cancellation policies vary depending on the service:
- Daily Deliveries & Standard Arrangements: Cancellations must be made at least 24 hours prior to the scheduled delivery or pick-up time for a full refund. Less than 24 hours notice may result in a partial refund or store credit, at our discretion.
- Weddings & Events: Specific cancellation terms will be outlined in your individual service agreement or quotation for these bespoke services. A non-refundable deposit is typically required to secure event dates and services.
- Workshops: Cancellations for workshops must be made at least 72 hours in advance for a full refund or transfer to another date. Cancellations within 72 hours are non-refundable, but tickets may be transferred to another person.
3. Pricing and Payment
All prices are listed in Australian Dollars (AUD) and are subject to change without notice. Payment is required in full upon order placement for most services, or as per the agreed payment schedule for large-scale events. We accept various payment methods as indicated on our online platform.
For custom orders or event floristry, a detailed quote will be provided outlining costs and payment terms.
4. Delivery and Collection
We offer delivery services within designated areas. Delivery fees apply and are calculated based on location. It is the customer's responsibility to provide accurate delivery information and ensure someone is available to receive the delivery. In cases where no one is available, products may be left in a safe place, or returned to our studio for collection, potentially incurring a re-delivery fee.
For collections, please adhere to the agreed-upon pick-up times. Bloom & Petal Co. is not responsible for products once they have been collected from our premises.
5. Product Care and Freshness
Floral products are perishable. We guarantee the freshness of our flowers upon delivery or collection. Detailed care instructions are often provided with your purchase. Bloom & Petal Co. is not responsible for the longevity of flowers or plants once they have been delivered or collected, especially if care instructions are not followed.
Should you have concerns about the quality or condition of your product upon receipt, you must contact us within 24 hours of delivery or collection with photographic evidence.
6. Copyright and Intellectual Property
All content on this website, including but not limited to designs, text, graphics, logos, images, and floristry concepts, is the property of Bloom & Petal Co. and is protected by copyright and intellectual property laws. You may not reproduce, distribute, display, or create derivative works of any content without our express written permission.
7. Limitation of Liability
Bloom & Petal Co. will not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use our services; (ii) any conduct or content of any third party on our services; (iii) any content obtained from our services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of Victoria, Australia, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms will be subject to the exclusive jurisdiction of the courts located in Victoria, Australia.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.
